NO individual student has any individual contract with Lessor, nor has any legal & tenancy rights; all rights accrue to the student by virtue of membership in the Group a.k.a Lessee, Tenant.
- RTA Notice --- Landlord only leases 1 DWELLING UNIT (Entire Property) to 1 Lessee/Tenant (Group) with 1 Lease for 1 Total Rent/DwellingUnit/Month. NO - Room Rentals, Individual Leases.
Important Protections** for Students
Legal Protections** --- Landlord DOES Protect Students via a) 100% Transparent Leasing Process, b) Detailed Group-Lease, c) Unfettered Access to Current Tenants. Group-Lease is per Laws of Ontario - a Commercial Contract legally binding Lessee & Lessor. Lessee Health, Safety, Security is #1 Covenant of Group-Lease & Non-Negotiable. Group-Lease treats Student > 16 years of age as legal adults. Parents do not sign the Group-Lease.
Physical Protections** --- Landlord DOES NOT allow - Room Rentals, Individual Leases. NO Random Renters or Strangers. Group Lease Only - Students alone decide on house-mates.
Financial Protections** --- Landlord DOES NOT allow or accept ----'price bidding', 'multiple offers', 'price jacking' --- The Listed Price is The Price.
Identity Theft Protections** --- Landlord DOES NOT See Student Financial Data - Credit Card, Debit Card, SIN, SS, Drivers Licence, Health Card, Bank Account etc.
Privacy Protections** --- Landlord DOES NOT take pictures inside house or apartment - such pictures are a serious risk to students privacy & potentially used by internet criminals. Students get a SPEC on our site & must personally visit the house to inspect it & talk to current tenants, BEFORE they Lease. Group-Lease has strict covenants protecting Students' Privacy Rights & PIPEDA. Landlord does not market or sell Student's Information.
Personal Protections** --- Landlord COMPLIES with all Ontario Laws - Legally treats Student Lessee Group as a de facto legal 'family' unit - legally 'related parties' - since they are unconditionally & irrevocably bound together jointly & severally liable to --- a) alone decide on Group Members i.e. 'family unit' , b) accept legal liability for each other & their actions, and c) live together as a 'family unit' - sharing all responsibilities & liabilities for legal, financial, rents, costs, meals, housekeeping, maintenance, by law compliance, utilities, friends, decisions, and all actions at leased Property.
Community Protections** --- Landlord DOES encourage cooperative Student/Community Relations --- to a) Protect Students' Health, Safety, and Security (Costs), b) Give Students a positive living experience, c) Protect the Community; whilst at our 5 6 7 Bedroom Houses for Student House Off Campus Housing.
City of Hamilton Licensing By Laws: City is planning to implement a program of Landlord & Property Licensing for all Rental Housing in Hamilton; including Student Housing. This Landlord will apply for any required License & comply with all requirements of any new By Law & Codes (e.g. Electrical Safety, Fire, HVAC etc). New Licensing & By Laws however unreasonable & irrational and subject to potential legal challanges, may require modifications of advertised configurations of the living spaces in the leased Property a.k.a. 1 DWELLING UNIT e.g. limiting number of formal shared kitchens to 1 main shared kitchen (each house i.e. 1 DWELLING UNIT to have only stoves & ovens in ONE shared kitchen), number of bedrooms allowable, and number of parking spaces allowable. Landlord's current advertising on their website & in their all Lease documents reflects the current state (wherein there is no Licensing requirement on Landlords for RENTAL Housing). Landlord will make the requisite changes to the leased Property a.k.a. 1 DWELLING UNIT as required per any new Licensing By Laws, and adjust the configuration of their rental properties accordingly e.g. reduce the number of formal kitchens to one shared kitchen (room with stove/oven), additional new parking on the Property etc. Landlord makes NO representations that the currently advertised configurations (e.g. number of formal shared kitchens in the house, number of bedrooms in the house) of their leased Properties will remain same after the new Licensing & By Laws are enacted (yet unknown). All currently advertised & agreed (Lease) Total Rent for leased Property a.k.a. 1 DWELLING UNIT reflect basic house configurations i.e. currently advertised # of bedrooms & washrooms, one main kitchen in each home with all requisite appliances; and any additional kitchen amenities in the 1 DWELLING-UNIT e.g. additional kitchens, additional stoves, fridges etc which addl. amenities per Lease provided for the 1 DWELLING UNIT at no additional cost, solely at the discretion of the Landlord - which amenities may have to be curtailed to comply with the new By Laws. In no case will the home be without the basic modern operating configuration & facilities/fixtures - legal bedrooms, 1 or more common (rec) rooms, 2 or more modern washrooms, 1 modern kitchen with multiple modern appliances (stove + 2 fridges), 1 laundry (washer & dryer), 1 modern furnace, 1 modern hot water heater, ESA & Fire & Gas Code compliant, and 24/7 warranty from Direct Energy etc. Total Rent for leased Property i.e. 1 DWELLING UNIT (based on # of Members in Lessee AND # of Bedrooms) - will be adjusted if the # of Bedrooms allowable per By Law has to change e.g. from 5 to 4. Landlord, is NOT in control of the aforementioned proposed City of Hamilton Licensing & By Laws for all Rental Housing; and accepts no liability flowing from it, save to comply fully with it. Lessee/Tenant release, indemnify, hold harmless, and waive all claim v Landlord/Lessor flowing from impact of said potential Licensing & By Laws & changes to their living conditions & potential behaviours therefrom. This is especially critical in areas of Lessee Health, Safety, and Security; and the compliance of both Lessee & Lessor with e.g. Usage of Living Spaces in the House, Fire Code e.g. NO disabling of fire alarms, Electrical Code, Parties, Public Disturbances, Parking, Noise, Snow Removal, Waste Management etc. Serious fines & charges flow from any violations & non compliance.
